FLORIDA HOA LAWS 2024 Update: Know Your Rights and Responsibilities!

Hey neighbors! Big changes are coming to our community thanks to new Florida laws for HOAs. Let's break down what this means for you and the HOA board.

Getting to Know Our Community Rules (HB 59):

  • What's changing? Every homeowner will receive a copy of the HOA's rules (CC&Rs) by October 1st, 2024 (digital or physical copy). This will help everyone understand our community guidelines.

  • What to do? The HOA board will be figuring out the best way to distribute the CC&Rs. Look out for updates on the website or upcoming meetings!

Hurricane Season Prep Made Easier (HB 293):

  • What's changing? The HOA will establish clear guidelines for hurricane protection (shutters, windows, etc.) You'll have more freedom to improve your home's storm protection as long as it meets the HOA's guidelines.

  • What to do? Stay tuned for updates from the HOA board on the new hurricane protection guidelines. They'll likely be discussed at upcoming meetings and posted online.

More Transparency and Resident Rights (HB 1203):

  • Easier access to records: HOAs with 100+ units will eventually (starting in 2026) allow homeowners to view important documents online or through a mobile app.

  • Your right to know: You have the right to a detailed breakdown of any HOA fees you owe. If the HOA delays this information, they can't fine you for late payments without prior notice.

  • Empowering our board: Board members will take educational courses to better understand their roles and responsibilities.

  • Fair and Clear Enforcement: The HOA will follow stricter guidelines when enforcing rules. Minor infractions won't be subject to fines anymore.

  • Voting goes digital (maybe): HOAs can now offer electronic voting, but only if residents approve it electronically.

  • Fairer Fees: HOAs can only charge simple interest on unpaid fees, not compounded interest.

What Didn't Pass This Year?

While these bills didn't pass yet, they show there's a focus on improving HOAs:

  • Limiting HOA fines

  • Easier communication with HOA management

  • Preventing HOA discrimination

  • Increased financial transparency

  • Free estoppel certificates
